Italy's highest court has overturned the conviction of a 60-year-old man for having sex with an 11-year-old girl, because the verdict failed to take into account their "amorous relationship".
Pietro Lamberti, a social services worker in Catanzaro in southern Italy, was convicted in February 2011 and sentenced to five years in prison for sexual acts with a minor.
The verdict was later upheld by an appeals court.
But Italy's supreme court ruled that the verdict did not sufficiently consider "the 'consensus', the existence of an amorous relationship, the absence of physical force, the girl's feelings of love"....
Lamberti was caught naked in bed with the girl after an investigation by police based largely on wire-tap evidence, it said.

Making Sad Sense of Child Abuse
Dec. 23, 2013 — When a man in Israel was accused of sexually abusing his young daughter, it was hard for many people to believe -- a neighbor reported seeing the girl sitting and drinking hot chocolate with her father every morning, laughing, smiling, and looking relaxed. Such cases are not exceptional, however. Children react to sexual and physical abuse in unpredictable ways, making it hard to discern the clues.
Now Dr. Carmit Katz of Tel Aviv University's Bob Shapell School of Social Work has found that when parents are physically abusive, children tend to accommodate it. But when the abuse is sexual, they tend to fight or flee it unless it is severe. The findings, published in Child Abuse & Neglect, help explain children's behavior in response to abuse and could aid in intervention and treatment.
"All the cases of alleged physical abuse in the study involved parents, while we had very few cases of alleged parental sexual abuse," said Dr. Katz. "More than the type of abuse, it may be that children feel they have no choice but to endure abuse by their parents, who they depend on for love and support."....
About 3.5 million cases of child abuse are reported in the United States every year. Similarly alarming situations exist in many other countries. Abused children often suffer from emotional and behavioral problems, which can later develop into sexual dysfunction, anxiety, promiscuity, vulnerability to repeated victimization, depression, and substance abuse.....
Dr. Katz says the study teaches an important lesson when it comes to parental physical abuse. Just because children do not fight or flee their parents does not mean they are not being abused. Children need their parents to survive, and in some cases, parents love, care for, and support their children when they are not abusing them. Under these impossible circumstances, children often feel their best option is accommodation. In one interview in the study, a child said, "Daddy was yelling on me because I didn't do my homework, so I told him I am sorry you are right and brought him his belt." There were many similar examples.....

“Denial” is Ms. Stern’s plainspoken and very raw account of why, long before 9/11, she was driven to study terrorism and to put herself repeatedly into danger as she flew around the world, like some scholarly twin of the former CNN war correspondent Christiane Amanpour, interviewing committed terrorists. Central among the reasons, it turns out, was her own experience of terror. On Oct. 1, 1973, when Ms. Stern was 15 and her sister 14, the two of them, alone in a suburban house in leafy Concord, Mass., were raped by a man who cut the house’s telephone lines before walking inside and leading them upstairs.
Ms. Stern describes that evening in brutal detail. It was a night that changed her and taught her a dire lesson: “Shame can be sexually transmitted.” The crime wasn’t properly investigated. The police didn’t believe her when she said the rapist was a stranger. Stern was 15 and her sister Sara 14 when a blue-eyed stranger carrying a small handgun entered their home in Concord, Mass., on the evening of Oct. 1, 1973. The man threatened to kill them. Then he raped them. There was no one for the girls to turn to -- their mother was dead, their father on a business trip in Europe, the baby sitter had left them alone. The police refused to believe the girls didn't know the man. They were in denial. Worse, their father refused to cut short his trip to rush home.
A few months later -- his daughters' rapist still at large -- he told police they had gotten over it. He was in denial. But it took more than 30 years for Stern to discover that she, too, was in denial....Stern knew from therapy that she suffered from post-traumatic stress disorder (PTSD), a diagnosis she had denied for years....Stern was not content to confine herself to the personal. She talked to a fellow victim and met a veteran who was injured in Iraq and suffers from PTSD. While she doesn't equate rape with being maimed by a roadside bomb -- "I was not a victim of terrorism. We don't want to know what the boys we send to Iraq have done to others out of terror, or what others have done to them. We would rather not know about terror or be confronted with evil. This is as true about Abu Ghraib as it is about personal assaults and more private crimes, the crimes that occur inside families. But the victim, too, cannot bear to believe. She may bury or disassociate from or disown her pain.

Soon after, another rare thing happened. The leader of the Italian bishops’ conference acknowledged at a news conference that it was “possible” that bishops in Italy had covered up abuse, while his deputy said that in the past decade, 100 Italian priests had faced church trials in connection with the sexual abuse of minors.

Irish priest resigns over abuse case 27 Jun 2010 A priest in charge of protecting children in a rural diocese in Northern Ireland has been forced to resign over a case of child sex abuse filed against another priest under his authority. Earlier, an Irish Examiner report said Fr Bermingham in charge of the Diocese of Cloyne, in County Cork had received a note from a woman claiming abuse by a priest under his ministration. Bermingham had hushed up the matter and let his colleague know of the note before referring him to the police.
Bermingham said he had turned in the abuse statement which he received in May 2009 to the police and the Health Service Executive in the Irish Republic right away....This spring, a group of deaf men in Verona were granted a rare hearing on national television to denounce the priests they said serially molested them as children in a school for the deaf. “We just want justice,” said one of the men, Gianni Bisoli.

More than 50 people have been arrested in several states since the 2008 start of the investigation, U.S. Attorney Tim Morrison said in a statement, and authorities said they are seeking the extradition of several suspects from overseas. Immigration and postal agencies also took part in the investigation, along with state and local police.
"This is the largest crimes against children case brought anywhere by anyone," Assistant U.S. Attorney Steven D. DeBrota said.

Monsignor Mariano Crociata, the No. 2 official in the Italian bishops' conference, gave the estimate during a press conference on the sidelines of the bishops' general assembly, the ANSA and Apcom news agencies reported.
He declined to say how many of the cases resulted in condemnation or defrocking of the priest, or how many were reported to police. While saying the church officials cooperated with police, he insisted that Italian law doesn't require bishops to report suspected abuse.
Some lawyers for victims say bishops are required to report abuse since they are public officials. Vatican norms say bishops should follow civil laws in reporting abuse.

As Pope Benedict XVI prepares to make an address to the world for Easter Sunday tomorrow, the Vatican is fighting back. It has also lashed out at criticism from the media. Fr Raniero Cantalamessa, preacher to the papal household, yesterday told a congregation that the current "violent and concentric attacks" on the church and the Pontiff were "reminiscent of the most shameful aspects of anti-Semitism". Above all, the church is casting doubt on the Pope's Polish-born predecessor's record in office, and his fast track to sainthood.

Cardinal Christoph Schonborn, the Archbishop of Vienna -- a staunch supporter of Pope Benedict, and seen as a possible successor -- put the blame on John Paul II and his advisers for failure to take action against Cardinal Hans Hermann Groer, Cardinal Schonborn's predecessor and a serial child-abuser. Cardinal Schonborn told 'L'Osservatore Romano', the Vatican newspaper, that as Head of the Congregation for the Doctrine of the Faith, which dealt with clerical sex abuse, the Pope (then Cardinal Ratzinger) had pressed John Paul in vain to investigate Cardinal Groer. Cardinal Groer stepped down in 1995 after being accused of molesting a schoolboy. After he resigned, allegations surfaced that he had also sexually abused young monks. He was never defrocked, however, and died in Germany in 2003.

Church warned about Quebec pedophile priest The Religieux Saint-Vincent-de-Paul order says Denis Vadeboncoeur was flagged April 7, 2010 The Canadian Press A Roman Catholic order in Quebec is defending its reputation after a former French bishop claimed he was asked to take in one of its priests who was found guilty of sexually abusing children in the 1980s.
Jacques Gaillot is a former bishop of Evreux, France, located about 100 kilometres west of Paris. Gaillot told a Parisian newspaper earlier this week he regretted appointing Denis Vadeboncoeur to head a parish in western France, where he was convicted in 2005 of child abuse....
But Vadeboncoeur's old order in Quebec, the Religieux Saint-Vincent-de-Paul, denies it had anything to do with Vadeboncoeur's career being allowed to continue in France. They said he went to France on his own initiative in 1987, two years after being given a 20-month sentence in Quebec for sexually assaulting children. He was originally charged in the province with gross indecency and sexually assaulting several children aged 12-17, as well as one count of sodomy. Order says French officials knew priest's past Upon learning of his new position in France, the order penned a letter, dated Oct. 29, 1987, to Gaillot informing him of Vadeboncoeur's past....The letter was sent to Gaillot again in 1988 and details Vadeboncoeur's crimes and punishment in Quebec, noting he served one-third of his sentence after pleading guilty. Vadeboncoeur received a 12-year prison sentence in 2005 in France after a much-covered trial related to the rape of several minors between 1989 and 1992.

By Nick Squires in Rome 06 Apr 2010 A report by prosecutors said that not one of the cases was referred to the police by the local bishop. Sergio Cavaliere, a lawyer who has compiled evidence on the cases, said: "It's an alarming figure if you consider that it's only the tip of the iceberg, if you think about all the cases that haven't shown up in the media or that haven't gone to court." A prosecutor in Milan, Pietro Forno, who has won 10 convictions for paedophile priests, claimed that police suspected the existence of a "network of clergy who have a passion for minors".
He said abusive priests had been shuffled between dioceses, where they were free to molest more children. "It seems that some chose the priesthood with the aim of being close to children," said Mr Forno, the head of a unit which investigates sex crimes....But signs are emerging that Italian priests sexually abused children in their care and were protected from investigation by bishops who were desperate not to harm the reputation of the Church....In Verona, in the north, almost 70 deaf men and women have claimed they were raped and molested over a period of about 30 years at a Church-run institute for deaf children.

Exiled Pedophile Priest May Have Continued Abuse By SUSAN SAULNY and LAURIE GOODSTEIN April 2, 2010 BOULDER JUNCTION, Wis....The house, in the Northwoods of Wisconsin, had been in the Rev. Lawrence C. Murphy's family for years, his getaway in the summer months and his sanctuary where he was sent to retire in 1974, at age 48, after victims of sexual abuse demanded he be removed from work at a school for the deaf near Milwaukee....But Father Murphy's time around Boulder Junction was not so secluded, according to recent interviews with people who live in the area and Roman Catholic Church documents. Those interviews and documents suggested that Father Murphy, who is accused of molesting as many as 200 boys at the school near Milwaukee, also used his family's lakefront cottage as a lure in his sexual advances, bringing youths from the school into his home beginning at least in the early 1960s.
What has recently come to light in fresh documents and interviews is that he was in the company of boys not only from the Milwaukee area but in the Northwoods region. Two in the area have accused Father Murphy of abuse, one at the isolated family cottage and the other, as late as 1978, at a youth detention center near Boulder Junction....In fact, around Boulder Junction, in high school religious classes and preparation for the sacrament of confirmation, in sleepovers at his cottage and fishing excursions, Father Murphy interacted freely with children until his death in 1998, never having been punished by the church or local criminal authorities in Milwaukee, according to documents and interviews with people in the area....at a Mass, Archbishop Jerome Listecki acknowledged that mistakes were made in the case of Father Murphy. As Pope Benedict XVI prepares to make an address to the world for Easter Sunday tomorrow, the Vatican is fighting back. It has also lashed out at criticism from the media. Fr Raniero Cantalamessa, preacher to the papal household, yesterday told a congregation that the current "violent and concentric attacks" on the church and the Pontiff were "reminiscent of the most shameful aspects of anti-Semitism". Above all, the church is casting doubt on the Pope's Polish-born predecessor's record in office, and his fast track to sainthood.

Cardinal Christoph Schonborn, the Archbishop of Vienna -- a staunch supporter of Pope Benedict, and seen as a possible successor -- put the blame on John Paul II and his advisers for failure to take action against Cardinal Hans Hermann Groer, Cardinal Schonborn's predecessor and a serial child-abuser. Cardinal Schonborn told 'L'Osservatore Romano', the Vatican newspaper, that as Head of the Congregation for the Doctrine of the Faith, which dealt with clerical sex abuse, the Pope (then Cardinal Ratzinger) had pressed John Paul in vain to investigate Cardinal Groer. Cardinal Groer stepped down in 1995 after being accused of molesting a schoolboy. After he resigned, allegations surfaced that he had also sexually abused young monks. He was never defrocked, however, and died in Germany in 2003.

Church warned about Quebec pedophile priest The Religieux Saint-Vincent-de-Paul order says Denis Vadeboncoeur was flagged April 7, 2010 The Canadian Press A Roman Catholic order in Quebec is defending its reputation after a former French bishop claimed he was asked to take in one of its priests who was found guilty of sexually abusing children in the 1980s.
Jacques Gaillot is a former bishop of Evreux, France, located about 100 kilometres west of Paris. Gaillot told a Parisian newspaper earlier this week he regretted appointing Denis Vadeboncoeur to head a parish in western France, where he was convicted in 2005 of child abuse....
But Vadeboncoeur's old order in Quebec, the Religieux Saint-Vincent-de-Paul, denies it had anything to do with Vadeboncoeur's career being allowed to continue in France. They said he went to France on his own initiative in 1987, two years after being given a 20-month sentence in Quebec for sexually assaulting children. He was originally charged in the province with gross indecency and sexually assaulting several children aged 12-17, as well as one count of sodomy. Order says French officials knew priest's past Upon learning of his new position in France, the order penned a letter, dated Oct. 29, 1987, to Gaillot informing him of Vadeboncoeur's past....The letter was sent to Gaillot again in 1988 and details Vadeboncoeur's crimes and punishment in Quebec, noting he served one-third of his sentence after pleading guilty. Vadeboncoeur received a 12-year prison sentence in 2005 in France after a much-covered trial related to the rape of several minors between 1989 and 1992.

Italy sees 130 priests investigated over abuse Italian authorities have arrested, investigated or convicted 130 Catholic priests for sexually abusing children over the last decade, it has been claimed. By Nick Squires in Rome 06 Apr 2010 A report by prosecutors said that not one of the cases was referred to the police by the local bishop. Sergio Cavaliere, a lawyer who has compiled evidence on the cases, said: "It's an alarming figure if you consider that it's only the tip of the iceberg, if you think about all the cases that haven't shown up in the media or that haven't gone to court." A prosecutor in Milan, Pietro Forno, who has won 10 convictions for paedophile priests, claimed that police suspected the existence of a "network of clergy who have a passion for minors".
He said abusive priests had been shuffled between dioceses, where they were free to molest more children. "It seems that some chose the priesthood with the aim of being close to children," said Mr Forno, the head of a unit which investigates sex crimes....But signs are emerging that Italian priests sexually abused children in their care and were protected from investigation by bishops who were desperate not to harm the reputation of the Church....In Verona, in the north, almost 70 deaf men and women have claimed they were raped and molested over a period of about 30 years at a Church-run institute for deaf children.

The attorney said the mother of a 5-year-old girl who was beaten to death at Schofield Barracks is not entitled to damages. The commanding general has said that opportunities were missed that could have prevented Talia Williams' death. Army lawyers said the general fired Schofield Barracks' top child abuse official for not reporting what she knew. However, the Army's lawyer said the Army should still not be held liable for their mistakes....Judge Alan Kay pointed out that the law considers them mandated reports of abuse. Our government, under the auspices of the CIA and U.S. military, has committed severe human rights violations that require a public apology and restitution. From the end of World War II through the 1970s, the United States government engaged in mind-control experimentation on human subjects, both adults and children. n1 These experiments included the use of drugs, hypnosis, electroshock, sexual abuse, and torture. n2 Justice remains elusive for those who have been the victims of these experiments. No one knows how many people were subjected to illegal and inhumane experiments by the U.S. government. n3 Much of the documentation of these experiments has been destroyed. n4 Documentation of other experiments has not been released, ostensibly for national security reasons. n5
An extremely small percentage of mind-control experimentation victims have received settlements under the Federal Tort Claims Act. n6 The majority of victims have received nothing. n7 None of the child victims, now adults, have received compensation for the wrongs they suffered. n8 The names and stories of the survivors are, for the most part, not found in court documents, government documents, or mainstream media reports. Instead, their stories are told in web postings and the notes of mental health workers, the outlets available to the marginalized and ignored. n9
In the past ten years, increasing numbers of mind-control experimentation survivors have begun to tell their stories. n10 As knowledge of these atrocities filters into the public consciousness, hopefully these survivors will begin to receive compensation for the pain they have suffered. Mind-control survivors face many obstacles in their pursuit of justice, obstacles that must be overcome if we as a society hope to maintain our ideal of equal justice for all citizens. Given the difficulty of proving the link between specific mind-control survivors and CIA documentation of mind-control experiments, and the length of time which many victims have needed in order to learn what has been done to them, there are significant legal obstacles to obtaining justice. We as a society are reluctant to look beyond our assumptions of humanity and acknowledge the inhumanity of which we are capable.
The tremendous violation of human rights that these experiments represent demands some form of restitution. Survivors of CIA and military mind-control experiments are entitled to both civil and criminal remedies. They deserve a public apology for what was done to them; their experiences must become an acknowledged part of the history of this country. It is our responsibility, as members of the society that permitted these experiments to take place, to insure that these survivors' needs are met. This Note will examine only the United States government's responsibility for the commission of these experiments. The liability and wrongdoing of private institutions and individuals, a further avenue of justice for survivors of mind-control experiments, is not within the scope of this note. Part II of this Note will discuss the mind-control experiments, including the connection between these experiments and Nazi Germany, and specific experiments performed on adults and children. Part III will address the ways in which mind-control experimentation survivors may seek justice, both through the court system and through legislation....
DID is often a response to severe childhood physical and sexual abuse. n112 An individual with DID is highly hypnotizable and subject to frequent amnesia. n113 Survivor memories indicate that CIA researchers created different personalities in the survivors for purposes including prostitution and assassination. n114 From a military perspective, an individual who could be trained as a military operative and conditioned to carry out orders with no conscious knowledge of such missions would be an ideal agent, impervious to hostile interrogation and utterly obedient.
The children who survived the mind-control experiments of the 1950s- 1970s have now grown to adulthood. The sex abuse scandal in the Roman Catholic Church came to the Pope's doorstep last night as a group of victims appeared on Italian television to claim that two dozen priests had for decades abused children at a school for the deaf in Verona. Three former pupils of the Antonio Provolo school who spoke on RAI, the state broadcaster, confirmed allegations made in a signed statement last year by 67 ex-pupils who described a regime of sexual abuse, paedophilia and corporal punishment from the 1950s to the 1980s. They said that 24 priests and lay brothers from the Company of Mary order were involved. The three said that the priests had "fondled and masturbated" them as well as sodomising them in dormitories, bathrooms and the priests' quarters. Among the accused is Monsignor Giuseppe Carraro, Bishop of Verona from 1958-78, who died in 1981 and whom the local diocese has sought to have beatified, a crucial step on the road to sainthood....
The present Bishop of Verona, Mgr Giuseppe Zenti, initially accused the former pupils of "hallucinating". However, the diocese had to open an inquiry after one of the accused lay brothers admitted sexual relations with pupils. Last summer the diocese forwarded its files on the abuse to the Congregation for the Doctrine of the Faith, which took no action until last month when Cardinal William Levada, Pope Benedict's successor as head of the congregation, agreed it was "opportune to proceed" with an inquiry....

Every survivor who shares his or her story in any setting is taking a courageous step to publicize government mind-control experimentation....
TEXT: Introduction
Our government, under the auspices of the CIA and U.S. military, has committed severe human rights violations that require a public apology and restitution. From the end of World War II through the 1970s, the United States government engaged in mind-control experimentation on human subjects, both adults and children. n1 These experiments included the use of drugs, hypnosis, electroshock, sexual abuse, and torture. n2 Justice remains elusive for those who have been the victims of these experiments. No one knows how many people were subjected to illegal and inhumane experiments by the U.S. government. n3 Much of the documentation of these experiments has been destroyed. n4 Documentation of other experiments has not been released, ostensibly for national security reasons. n5
An extremely small percentage of mind-control experimentation victims have received settlements under the Federal Tort Claims Act. n6 The majority of victims have received nothing. n7 None of the child victims, now adults, have received compensation for the wrongs they suffered. n8 The names and stories of the survivors are, for the most part, not found in court documents, government documents, or mainstream media reports. Instead, their stories are told in web postings and the notes of mental health workers, the outlets available to the marginalized and ignored. n9
In the past ten years, increasing numbers of mind-control experimentation survivors have begun to tell their stories. n10 As knowledge of these atrocities filters into the public consciousness, hopefully these survivors will begin to receive compensation for the pain they have suffered. Mind-control survivors face many obstacles in their pursuit of justice, obstacles that must be overcome if we as a society hope to maintain our ideal of equal justice for all citizens. Given the difficulty of proving the link between specific mind-control survivors and CIA documentation of mind-control experiments, and the length of time which many victims have needed in order to learn what has been done to them, there are significant legal obstacles to obtaining justice. We as a society are reluctant to look beyond our assumptions of humanity and acknowledge the inhumanity of which we are capable.
The tremendous violation of human rights that these experiments represent demands some form of restitution. Survivors of CIA and military mind-control experiments are entitled to both civil and criminal remedies. They deserve a public apology for what was done to them; their experiences must become an acknowledged part of the history of this country. It is our responsibility, as members of the society that permitted these experiments to take place, to insure that these survivors' needs are met. This Note will examine only the United States government's responsibility for the commission of these experiments. The liability and wrongdoing of private institutions and individuals, a further avenue of justice for survivors of mind-control experiments, is not within the scope of this note. Part II of this Note will discuss the mind-control experiments, including the connection between these experiments and Nazi Germany, and specific experiments performed on adults and children. Part III will address the ways in which mind-control experimentation survivors may seek justice, both through the court system and through legislation....
DID is often a response to severe childhood physical and sexual abuse. n112 An individual with DID is highly hypnotizable and subject to frequent amnesia. n113 Survivor memories indicate that CIA researchers created different personalities in the survivors for purposes including prostitution and assassination. n114 From a military perspective, an individual who could be trained as a military operative and conditioned to carry out orders with no conscious knowledge of such missions would be an ideal agent, impervious to hostile interrogation and utterly obedient.
The children who survived the mind-control experiments of the 1950s- 1970s have now grown to adulthood. Verona deaf school ex-pupils tell Italian TV of sex abuse by priests Richard Owen, Rome March 27, 2010
The sex abuse scandal in the Roman Catholic Church came to the Pope's doorstep last night as a group of victims appeared on Italian television to claim that two dozen priests had for decades abused children at a school for the deaf in Verona. Three former pupils of the Antonio Provolo school who spoke on RAI, the state broadcaster, confirmed allegations made in a signed statement last year by 67 ex-pupils who described a regime of sexual abuse, paedophilia and corporal punishment from the 1950s to the 1980s. They said that 24 priests and lay brothers from the Company of Mary order were involved. The three said that the priests had "fondled and masturbated" them as well as sodomising them in dormitories, bathrooms and the priests' quarters. Among the accused is Monsignor Giuseppe Carraro, Bishop of Verona from 1958-78, who died in 1981 and whom the local diocese has sought to have beatified, a crucial step on the road to sainthood....
The present Bishop of Verona, Mgr Giuseppe Zenti, initially accused the former pupils of "hallucinating". However, the diocese had to open an inquiry after one of the accused lay brothers admitted sexual relations with pupils. Last summer the diocese forwarded its files on the abuse to the Congregation for the Doctrine of the Faith, which took no action until last month when Cardinal William Levada, Pope Benedict's successor as head of the congregation, agreed it was "opportune to proceed" with an inquiry....
