U.N. Faults U.S. For Failure To Prosecute Abusive Clerics

WASHINGTON (RNS) The U.S. is failing to pursue and prosecute clergy guilty of child sexual abuse, according to a recent United Nations committee report. The U.N.'s Committee on the Rights of the Child, in a little-noticed Jan. 25 report, urged the U.S. to "take all necessary measures to investigate all cases of sexual abuse of children whether single or on a massive and long-term scale, committed by clerics."
David Clohessy, the director of Survivors Network of those Abused by Priests, described national efforts to deal with child-molesting clergy as "woefully inadequate." "There has been and continues to be too cozy a relationship between religious and governmental figures," Clohessy said. "Other than a handful of local prosecutors, there's been almost no action at the state or federal level."
The U.S. Department of Justice did not return requests for comment, and the National Association of Attorneys General declined to comment. Abuse cases are typically handled by local and state prosecutors, not the federal government....

NEW YORK — Cardinal Timothy Dolan, the archbishop of New York, was deposed Wednesday about abuse cases against Roman Catholic clergy in the Archdiocese of Milwaukee, which he led from 2002 until 2009. Frank LoCoco, an attorney for the Milwaukee Archdiocese, and Jeff Anderson, a plaintiffs' attorney, confirmed the cardinal was deposed.
The Milwaukee Archdiocese faces allegations from nearly 500 people. Archbishop Jerome Listecki, the current Milwaukee church leader, sought bankruptcy protection in 2011, saying the process was needed to compensate victims fairly while ensuring the archdiocese could still function. Milwaukee is the eighth diocese in the U.S. to seek bankruptcy protection since the abuse scandal erupted in 2002 in Boston.
Dolan is one of two U.S. cardinals to be deposed this week. Cardinal Roger Mahony, the retired archbishop of Los Angeles, is scheduled to be questioned Saturday in a lawsuit over a visiting Mexican priest who police believe molested 26 children in 1987. The Rev. Nicolas Aguilar Rivera fled to Mexico in 1988 after parents complained. He has been ousted from the priesthood but remains a fugitive.

TV content affects children's behavior over time

Both the quantity and the content of television viewing by children may affect social behaviors long term, with effects that may last into adulthood, the results of two studies have shown.
In one randomized, controlled trial involving 565 preschool-aged children in the United States, coaching parents to reduce viewing of violence on the screen and to increase exposure to prosocial programming resulted in significantly less aggression and more prosocial behavior in the children after 6 months compared with the control group, effects that mostly were maintained at 12 months, Dr. Dmitri A. Christakis and his associates reported.
A separate longitudinal study from New Zealand followed 1,037 people from birth to age 26 years and found a significantly increased risk for antisocial outcomes in adults who had watched the most TV as children. Every extra hour of weeknight TV watching as children was associated with a 30% increase in the likelihood of having a criminal conviction by age 26, reported Lindsay A. Robertson and her associates.
Previous studies have shown that children imitate what they see on the screen and that reducing TV watching reduced aggression in 9-year-olds. Few studies have looked at preschoolers or at interventions aimed at content, Dr. Christakis said.
His study found that children fed a "media diet" deemphasizing violent programs and promoting viewing of programs that focus on sharing, caring, and education had Social Competence and Behavior Evaluation (SCBE) scores at 6 months that were 2 points better than in the control group, a significant difference that continued at 12 months (Pediatrics 2013;131:431-8)....

Panel reveals new details of 1940's experiment

A presidential panel on Monday disclosed shocking new details of U.S. medical experiments done in Guatemala in the 1940s, including a decision to re-infect a dying woman in a syphilis study.
The Guatemala experiments are already considered one of the darker episodes of medical research in U.S. history, but panel members say the new information indicates that the researchers were unusually unethical, even when placed into the historical context of a different era.
"The researchers put their own medical advancement first and human decency a far second," said Anita Allen, a member of the Presidential Commission for the Study of Bioethical Issues.
From 1946-48, the U.S. Public Health Service and the Pan American Sanitary Bureau worked with several Guatemalan government agencies to do medical research — paid for by the U.S. government — that involved deliberately exposing people to sexually transmitted diseases.
The researchers apparently were trying to see if penicillin, then relatively new, could prevent infections in the 1,300 people exposed to syphilis, gonorrhea or chancroid. Those infected included soldiers, prostitutes, prisoners and mental patients with syphilis.
The commission revealed Monday that only about 700 of those infected received some sort of treatment. Also, 83 people died, although it's not clear if the deaths were directly due to the experiments.
The research came up with no useful medical information, according to some experts. It was hidden for decades but came to light last year, after a Wellesley College medical historian discovered records among the papers of Dr. John Cutler, who led the experiments.
President Barack Obama called Guatemala's president, Alvaro Colom, to apologize. He also ordered his bioethics commission to review the Guatemala experiments. That work is nearly done. Though the final report is not due until next month, commission members discussed some of the findings at a meeting Monday in Washington.
They revealed that some of the experiments were more shocking than was previously known....
During that time, other researchers were also using people as human guinea pigs, in some cases infecting them with illnesses. Studies weren't as regulated then, and the planning-on-the-fly feel of Cutler's work was not unique, some experts have noted....

Dr. Bruce Jessen's handwritten notes describe some of the torture techniques that were used to "exploit" "war on terror" detainees in custody of the CIA and Department of Defense.
Bush administration officials have long asserted that the torture techniques used on "war on terror" detainees were utilized as a last resort in an effort to gain actionable intelligence to thwart pending terrorist attacks against the United States and its interests abroad.
But the handwritten notes obtained exclusively by Truthout drafted two decades ago by Dr. John Bruce Jessen, the psychologist who was under contract to the CIA and credited as being one of the architects of the government's top-secret torture program, tell a dramatically different story about the reasons detainees were brutalized and it was not just about obtaining intelligence. Rather, as Jessen's notes explain, torture was used to "exploit" detainees, that is, to break them down physically and mentally, in order to get them to "collaborate" with government authorities. Jessen's notes emphasize how a "detainer" uses the stresses of detention to produce the appearance of compliance in a prisoner.
....However, according to the Senate Armed Services Committee report "SERE resistance training ... was used to inform" Yoo and Bybee's torture memo, specifically, nearly a dozen of the brutal techniques detainees were subjected to, which included waterboarding, sleep deprivation, painful stress positions, wall slamming and placing detainees in a confined space, such as a container, where his movement is restricted.

The fact is that senior officials in the United States government solicited information on how to use aggressive techniques, redefined the law to create the appearance of their legality, and authorized their use against detainees.
....On February 7, 2002, President Bush signed a memorandum stating that the Third Geneva Convention did not apply to the conflict with al Qaeda and concluding that Taliban detainees were not entitled to prisoner of war status or the legal protections afforded by the Third Geneva Convention. The President’s order closed off application of Common Article 3 of the Geneva Conventions, which would have afforded minimum standards for humane treatment, to al Qaeda or Taliban detainees. While the President’s order stated that, as “a matter of policy, the United States Armed Forces shall continue to treat detainees humanely and, to the extent appropriate and consistent with military necessity, in a manner consistent with the principles of the Geneva Conventions,” the decision to replace well established military doctrine, i.e., legal compliance with the Geneva Conventions, with a policy subject to interpretation, impacted the treatment of detainees in U.S. custody.

The ACLU calls on the Council to urge the United States to take concrete and appropriate measures to end the egregious violations stemming from solitary confinement of prisoners."

Written in a dry, bureaucratic style, the report recounts a number of examples of well-known Nazis to whom both the CIA and Department of State had provided both shelter and employment to, including Adolph Eichman, Otto Von Bolschwing, Dr. Josef Mengele, and Arthur Rudolph. To the purposes of this article, it is important to underscore here that the long-concealed report makes no mention whatsoever of the many Nazi scientists who specialized in chemical, biological and radioactive warfare and who were secretly relocated in the United States between the years 1946 and 1958....
"Operation Paperclip" transferred to the U.S. over 1,600 Nazi scientists, largely escaping the Nuremberg trials. Men who were classified as ’ardent Nazis’ were chosen - just weeks after Hitler’s defeat - to become ’respectable’ U.S. citizens, some of whom are allegedly still working in places like Brookhaven labs, Cold Spring Harbor and Plum Island. Reports that several servicemen died in these experiments have persisted for decades, but the Pentagon refuses to release any documents concerning the experiments....
Project Paperclip brought Dr. Herbert Bruno Gerstner from Germany to the United States in 1949....Prior to coming to America, Gerstner had spent much of his professional career in Leipzig, Germany. There he worked for the University of Leipzig. Some readers may recall that the University employed a number of physicians who were quite prominent in the Nazi’s euthanasia program aimed at the mentally ill, including large numbers of children.

Last month, the FBI announced the results of Operation Cross Country V, a 40-city investigation that led to the rescue of 69 children who were being victimized through prostitution. More than 800 people, including 99 pimps, were arrested.
According to the FBI, more than 100,000 children are sold for sex in the U.S. each year. In a two-part series, Youth Radio takes a look at the problem of child prostitution in the U.S. Today, two young women who recently escaped what's called "the game" share their stories....

....Yesterday, former priest Tony Walsh (57) was jailed for 16 years for abusing three young altar boys in Ballyfermot, Dublin. One of the boys was repeatedly raped over several years between the age of seven and 12; and he indecently assaulted the two other boys. Sentencing him yesterday, Judge Frank O’Donnell labelled Walsh a “serial offender” who had inflicted a “life sentence” on one of his victims....Through their dignified victim impact statements, the three men yesterday revealed how the abuse has scarred them and continues to damage their lives.
“Following the abuse, I turned to drink and drugs to numb the pain,” David said. “My trust was gone towards people . . . When I was around 16, I attempted suicide. It was the first of numerous attempts.” Another victim, “Noel”, told how his parents refused to believe him when he disclosed he was being abused. Their response devastated him. “My mother said: ‘How could you say that about a man of the cloth, a man of God?’ My father gave me a hiding which started in the kitchen and finished in the bedroom.”

Last month, the FBI announced the results of Operation Cross Country V, a 40-city investigation that led to the rescue of 69 children who were being victimized through prostitution. More than 800 people, including 99 pimps, were arrested.

....Yesterday, former priest Tony Walsh (57) was jailed for 16 years for abusing three young altar boys in Ballyfermot, Dublin. One of the boys was repeatedly raped over several years between the age of seven and 12; and he indecently assaulted the two other boys. Sentencing him yesterday, Judge Frank O’Donnell labelled Walsh a “serial offender” who had inflicted a “life sentence” on one of his victims....Through their dignified victim impact statements, the three men yesterday revealed how the abuse has scarred them and continues to damage their lives.
“Following the abuse, I turned to drink and drugs to numb the pain,” David said. “My trust was gone towards people . . . When I was around 16, I attempted suicide. It was the first of numerous attempts.” Another victim, “Noel”, told how his parents refused to believe him when he disclosed he was being abused. Their response devastated him. “My mother said: ‘How could you say that about a man of the cloth, a man of God?’ My father gave me a hiding which started in the kitchen and finished in the bedroom.”

Child Prostitution Busts in the United States
FBI: 69 children, 99 pimps found in national bust - Associated Press November 8, 2010 More than five dozen child prostitutes have been found in the last three days as part of a nationwide crackdown on the sexual exploitation of children, the FBI said Monday. FBI spokesman Jason Pack said 69 children were removed from prostitution and 99 suspected pimps were arrested in 40 cities across 30 states and the District of Columbia. Authorities arrested 785 other adults on a variety state and local charges, Pack said. All the children found in the last three days have been placed into protective custody or returned to their families.
The children were found during Operation Cross Country V, a three-day roundup targeting child traffickers and pimps. The largest group of child prostitutes, 24, was found in and around Seattle, according to the FBI. FBI executive assistant director Shawn Henry said the children found ranged in age from 12 to 17....Since 2003, when the FBI and the Justice Department launched the Innocence Lost National Initiative, about 1,250 child prostitutes have been located and removed from prostitution.

MILWAUKEE, Wisconsin – Terry Kohut has kept a dark secret for nearly 50 years. Now he is breaking his silence, becoming a key figure in the sex-abuse crisis in the Catholic Church and the growing controversy over what Pope Benedict XVI did about it.
When Kohut was barely a teen, and for years afterward, he says, he was sexually molested and assaulted by the headmaster and priest of the school where he lived, St. John’s School for the Deaf, in Milwaukee, Wisconsin. What occurred there is one of the most notorious cases of sex abuse in the Catholic Church.
Kohut was not alone. From 1950 to 1974 the headmaster of St. Johns, Father Lawrence C. Murphy, raped and molested as many as 200 deaf boys, according to court and church documents.
Kohut has now filed the first sex-abuse lawsuit against the Vatican actually naming Pope Benedict, previously known as Cardinal Joseph Ratzinger, as a defendant.
Ratzinger was once head of the Vatican’s powerful CDF, the Congregation for the Doctrine of the Faith, charged in certain circumstances with investigating the sexual abuse of minors by priests. And though church records show the abuse by Father Murphy was brought to the attention of Ratzinger and the CDF years ago, a church trial against the headmaster was stopped and he was allowed to remain a priest.
The Vatican’s “policy of secrecy” in abuse cases, and its “directives to conceal the sexual abuse of children” by priests, the lawsuit says, helped bring about the abuse of Kohut and others by Father Murphy....
Steven Geier and Carl Nelson were also deaf students who say Father Murphy sexually assaulted them repeatedly. They say Father Murphy would prowl the dorm at night, visiting boys in their beds, raping and sexually assaulting them. He would also routinely assault and molest his victims in one of the church’s most sacred places – the confessional – church documents show....Minnesota attorney Jeff Anderson is the lead lawyer in Kohut’s lawsuit. Anderson has filed hundreds of lawsuits for sexual abuse victims of priests, and has obtained a massive trove of internal Vatican documents to build his case against the pope. He says numerous abuse cases show that Vatican officials all the way to the top, including then Cardinal Ratzinger, did little to help the victims, and were mostly interested in protecting the church from scandal....Groups of boys tried to tell local police and even the local District Attorney in Milwaukee about what was being done to them, according to Kohut, Geier, Nelson and others CNN interviewed. But no one ever believed their story, and local police even drove them back to the school, returning the boys to Father Murphy.
After years of allegations and reports of abuse, and threats of lawsuits, local bishops finally moved Father Murphy in 1974 to remote northern Wisconsin. There, more abuse allegations later surfaced.

Howard Loeb, senior aquatic biologist at the New York State Conservation Department Fish Laboratory in Livingston Manor, is feeding fish LSD-25 and other hallucinogenic drugs ordinarily used in treatment of the mentally disturbed, and if the experiments work out successfully—which they show promise of doing—their application will have a wholly revolutionary effect not only on angling but on commercial fishing as well.
....Several years ago Dr. Harold A. Abramson, Director of Psychiatric Research at South Oaks Psychiatric Hospital in Amityville, N.Y., chanced to read of Loeb's work on carp poisons, and he offered a suggestion: use LSD-25, a hallucinogenic drug derived from d-lysergic acid, originally found in the ergot fungus that grows on rye. Discovered by a Swiss pharmaceutical firm nearly two decades ago and later patented, LSD-25 is a potent tool in mental-illness research. It enables patients to recall events that occurred in very early childhood and that may be at the root of their difficulties. The drug is perhaps best known to the general public because of the psychological effects it brings about. Colors take on great depth, music is physically felt rather than heard and happiness or frustration is often extreme. It produces in a normal person a state believed to be similar to schizophrenia.
That is why Dr. Abramson started experimenting with LSD. He is one of the supporters of the theory that schizophrenia is caused by a chemical imbalance in the body. If he could use LSD or another derivative of d-lysergic acid on a laboratory animal to bring about simulated schizophrenia, then find another chemical agent that could block this simulated case, he would have a strong clue to the mechanism involved in clinical schizophrenia.....
Loeb first began testing with LSD-25, then, with the help of an American pharmaceutical house, Eli Lilly and Co. of Indianapolis, started testing other compounds made from d-lysergic acid. So far Loeb has tested some 40 drugs supplied by Lilly on carp, goldfish, golden and common shiners, blacknose dace, yellow perch, pumpkinseed sun-fish, white suckers, bullheads, brook trout and brown trout. With the exception of the trout and the bullheads—which swim to the surface—the fish pop up to the top of the water, swim backward and often go into a stupor. Goodness knows what kinds of hallucinations carp have—perhaps they dream they are gefilte fish—but they become noticeably lighter in color. Transferred to a fresh tank, affected fish appear intoxicated up to several hours, then become darker in color and start to respond by sight to people and approaching nets. Left in the original test tank, the fish snap to after several days. "My idea in experimenting with these drugs," says Loeb, "is to find out which ones bring the fish up the best with a modest dose and then become nontoxic the quickest."....
"Loeb," says Dr. Abramson, who marvels at the progress, "is doing real pioneering. He has the foresight to explore the unknown. He's doing important work in experimental biology, and I wouldn't be surprised if in studying fish he came up with a contribution of definite value for our work on mental illness."

Vatican denies abuse liability, Pope implicated, bishop accused beating orphans
Law firm implicates Vatican, Pope in abuse case By CHRISTINE ARMARIO AP March 31, 2010 MIAMI - A South Florida law firm is implicating the Vatican and Pope Benedict XVI in its handling of a priest accused of sexually abusing children. Jessica Arbour, an attorney representing one of the alleged victims, says documents show the Vatican was aware of Rev. Ernesto Garcia-Rubio's misconduct as early as 1968. Thirteen years later, Benedict became head of the Vatican office that received a petition from Garcia-Rubio seeking to leave the priesthood. Arbour says the paperwork was lost. Arbour says they do not have any evidence indicating children were abused during that time. A lawsuit has been filed against the Archdiocese of Miami, claiming it was negligent in its supervision and assignment of the reverend. Arbour says it may be amended to include the Vatican.

Vatican offers 3 reasons it's not liable for abuse By NICOLE WINFIELD, AP Mar 30, 2010 VATICAN CITY – Dragged deeper than ever into the clerical sex abuse scandal, the Vatican is launching a legal defense that it hopes will shield the pope from a lawsuit in Kentucky seeking to have him answer attorneys' questions under oath. Court documents obtained Tuesday by The Associated Press show that Vatican lawyers plan to argue that the pope has immunity as head of state, that American bishops who oversaw abusive priests weren't employees of the Vatican, and that a 1962 document is not the "smoking gun" that provides proof of a cover-up.
The Holy See is trying to fend off the first U.S. case to reach the stage of determining whether victims actually have a claim against the Vatican itself for negligence for allegedly failing to alert police or the public about Roman Catholic priests who molested children.
The case was filed in 2004 in Kentucky by three men who claim they were abused by priests and claim negligence by the Vatican. Their attorney, William McMurry, is seeking class-action status for the case, saying there are thousands of victims across the country.
"This case is the only case that has been ever been filed against the Vatican which has as its sole objective to hold the Vatican accountable for all the priest sex abuse ever committed in this country," he said in a phone interview. "There is no other defendant. There's no bishop, no priest." The case was filed in 2004 in Kentucky by three men who claim they were abused by priests and claim negligence by the Vatican. Their attorney, William McMurry, is seeking class-action status for the case, saying there are thousands of victims across the country.
"This case is the only case that has been ever been filed against the Vatican which has as its sole objective to hold the Vatican accountable for all the priest sex abuse ever committed in this country," he said in a phone interview. "There is no other defendant. There's no bishop, no priest." The Bishop of Augsburg, 68, denies the claims by five former pupils at a Catholic-run orphanage and care facility. Our government, under the auspices of the CIA and U.S. military, has committed severe human rights violations that require a public apology and restitution. From the end of World War II through the 1970s, the United States government engaged in mind-control experimentation on human subjects, both adults and children. n1 These experiments included the use of drugs, hypnosis, electroshock, sexual abuse, and torture. n2 Justice remains elusive for those who have been the victims of these experiments. No one knows how many people were subjected to illegal and inhumane experiments by the U.S. government. n3 Much of the documentation of these experiments has been destroyed. n4 Documentation of other experiments has not been released, ostensibly for national security reasons. n5
An extremely small percentage of mind-control experimentation victims have received settlements under the Federal Tort Claims Act. n6 The majority of victims have received nothing. n7 None of the child victims, now adults, have received compensation for the wrongs they suffered. n8 The names and stories of the survivors are, for the most part, not found in court documents, government documents, or mainstream media reports. Instead, their stories are told in web postings and the notes of mental health workers, the outlets available to the marginalized and ignored. n9
In the past ten years, increasing numbers of mind-control experimentation survivors have begun to tell their stories. n10 As knowledge of these atrocities filters into the public consciousness, hopefully these survivors will begin to receive compensation for the pain they have suffered. Mind-control survivors face many obstacles in their pursuit of justice, obstacles that must be overcome if we as a society hope to maintain our ideal of equal justice for all citizens. Given the difficulty of proving the link between specific mind-control survivors and CIA documentation of mind-control experiments, and the length of time which many victims have needed in order to learn what has been done to them, there are significant legal obstacles to obtaining justice. We as a society are reluctant to look beyond our assumptions of humanity and acknowledge the inhumanity of which we are capable.
The tremendous violation of human rights that these experiments represent demands some form of restitution. Survivors of CIA and military mind-control experiments are entitled to both civil and criminal remedies. They deserve a public apology for what was done to them; their experiences must become an acknowledged part of the history of this country. It is our responsibility, as members of the society that permitted these experiments to take place, to insure that these survivors' needs are met. This Note will examine only the United States government's responsibility for the commission of these experiments. The liability and wrongdoing of private institutions and individuals, a further avenue of justice for survivors of mind-control experiments, is not within the scope of this note. Part II of this Note will discuss the mind-control experiments, including the connection between these experiments and Nazi Germany, and specific experiments performed on adults and children. Part III will address the ways in which mind-control experimentation survivors may seek justice, both through the court system and through legislation....
DID is often a response to severe childhood physical and sexual abuse. n112 An individual with DID is highly hypnotizable and subject to frequent amnesia. n113 Survivor memories indicate that CIA researchers created different personalities in the survivors for purposes including prostitution and assassination. n114 From a military perspective, an individual who could be trained as a military operative and conditioned to carry out orders with no conscious knowledge of such missions would be an ideal agent, impervious to hostile interrogation and utterly obedient.
The children who survived the mind-control experiments of the 1950s- 1970s have now grown to adulthood. The sex abuse scandal in the Roman Catholic Church came to the Pope's doorstep last night as a group of victims appeared on Italian television to claim that two dozen priests had for decades abused children at a school for the deaf in Verona. Three former pupils of the Antonio Provolo school who spoke on RAI, the state broadcaster, confirmed allegations made in a signed statement last year by 67 ex-pupils who described a regime of sexual abuse, paedophilia and corporal punishment from the 1950s to the 1980s. They said that 24 priests and lay brothers from the Company of Mary order were involved. The three said that the priests had "fondled and masturbated" them as well as sodomising them in dormitories, bathrooms and the priests' quarters. Among the accused is Monsignor Giuseppe Carraro, Bishop of Verona from 1958-78, who died in 1981 and whom the local diocese has sought to have beatified, a crucial step on the road to sainthood....
The present Bishop of Verona, Mgr Giuseppe Zenti, initially accused the former pupils of "hallucinating". However, the diocese had to open an inquiry after one of the accused lay brothers admitted sexual relations with pupils. Last summer the diocese forwarded its files on the abuse to the Congregation for the Doctrine of the Faith, which took no action until last month when Cardinal William Levada, Pope Benedict's successor as head of the congregation, agreed it was "opportune to proceed" with an inquiry....
