Federal lawsuit filed in La Vernia sexual assault hazing scandal

LA VERNIA, Texas - The parents of a La Vernia rape victim filed a federal lawsuit seeking monetary damages after 10 students were arrested in connection with widespread hazing accusations at the high school, according to the family's attorney.

The complaint was filed in the Western District of Texas Thursday "seeking injunctive relief and monetary damages arising from their son’s sodomization as part of a team 'initiation' ritual, allegedly known about by administrators and coaches in the La Vernia Independent School District."

The lawsuit seeks damages for civil rights violations.

Specific allegations included in the lawsuit are as follows:

"The subject hazing rituals and traditions are a form of bullying and have been part of the culture of the School’s football team for at least a decade, according to news accounts, and possibly longer.

The teams’ coaches have sanctioned these rituals, while other school officials, including La Vernia ISD and the School’s principal, athletic director, and coaches, turned a blind eye toward the abuse, even after the abuse was reported to them.

Indeed, the Plaintiffs are but a fraction of the students who have been physically and sexually assaulted pursuant to these sadistic hazing rituals which include rape, sodomy, unlawful sexual penetration, and sexual abuse. In addition to seeking damages to compensate Plaintiffs for their psychological injuries, CHILD DOE, who still attends the School, also seek injunctive relief that will put an end to the hazing rituals, so that neither they nor future members of the School’s football team will be subjected to the same abuses Plaintiffs have suffered."....

Another La Vernia varsity football player arrested Wednesday

LA VERNIA - On Wednesday afternoon, another La Vernia High School athlete was put in handcuffs, charged with a felony offense of sexual assault.

That makes 10 arrests so far: three adults and seven teens involved in a horrific hazing scandal.

Two court documents obtained by KENS 5 detail why two varsity football players were arrested on campus Monday, then another on Wednesday.

When the news broke, it shocked the entire La Vernia community. As residents told us, this scandal is not one to forget, but they're hoping everyone will at least forgive.

Dustin Norman, Robert Olivarez Jr., and Alejandro Ibarra are three La Vernia High School varsity football players facing adult sexual assault charges.

Criminal complaints reveal the assault happened in November of 2016 in a home off campus. The documents say that it was part of an initiation process after the 16-year-old victim moved from JV to the varsity football team.

The victim claims Norman, Olivarez, Ibarra and an underage suspect yelled "get him," held him down on a bed, and used the threaded end of a CO2 air tank to sexually assault him.

Norman, Olivarez, and Ibarra are just three of 10 arrests so far. The others are minors.....

Tinyiko Mongwe was stabbed to death by a 21-year-old man while playing with friends on Monday.

An attorney helping an anonymous California woman accusing Donald Trump in a federal lawsuit of raping her in the ’90s when she was 13 announced that the woman would go public for the first time Wednesday.

But as the press conference was about to begin in the California offices of attorney Lisa Bloom, Bloom called it off, citing threats to the plaintiff, known in court papers as Jane Doe.

“Jane Doe has received numerous threats today … She has decided she is too afraid to show her face,” Bloom said, according to the tweets of MSNBC/NBC reporter Irin Carmon. “We’re going to have to reschedule....

Jane Doe accuses Trump of raping her during the summer of 1994 when she was 13, allegedly in the home of Jeffrey Epstein, a convicted pedophile also named in the lawsuit.

She also claims that: “Immediately following this rape, Defendant Trump threatened me that, were I ever to reveal any of the details of Defendant Trump’s sexual and physical abuse of me, my family and I would be physically harmed if not killed.”

Alan Garten, vice president and general counsel for the Trump Organization, did not return a call for comment to PEOPLE. But Garten has repeatedly and vehemently denied the allegations, telling the New York Daily News they were “categorically untrue, completely fabricated and politically motivated....

When the presidential candidates debated last month for the second time, Donald Trump claimed that Hillary Clinton once laughed at a victim of rape. The allegation stems from a case that Clinton worked as a young lawyer in 1975 — she defended one of two men accused of raping then 12-year-old Kathy Shelton.

Trump featured Shelton in a press conference that was broadcast on Facebook Live ahead of the debate and then brought her in to sit with the audience. Trump spoke about Shelton on stage, arguing Clinton mistreated her....

Shelton told Morning Edition's Steve Inskeep that on that day in 1975 she was stopped while riding her bike to church and beaten, raped and dumped out of a truck....

As the prosecutor recalls it, Rodham tried to get out of it.

"She apparently went to the judge, and he refused to let her out," Gibson said. "And at that point, she fired all guns. She mounted an excellent defense, I'll give her credit for that."

Gibson says she challenged the physical evidence, and also raised questions about the victim's story and her credibility. With the case looking doubtful, prosecutors accepted a plea bargain. The attacker received a short prison term and a fine....

After reviewing the transcript decades later, Reid says Clinton never laughed at a rape victim.

"She was laughing at the vagaries of the legal system that play out every day across America in one way or another," he told NPR.

Shelton has a different interpretation.

"To me she's saying, they're guilty, and she's laughing about it," she said....

However, she told NPR, as she better grasped the story, she does feel Clinton traumatized her a second time in the justice system....

Shelton's lawyer today is Candice Jackson. She argues that Clinton went too far, by questioning the victim's reliability....

A 10-year-old girl who said she was raped was kept behind bars for several hours after trying to report the crime, according to multiple news outlets.

The incident occurred Monday in the Indian city of Bulandshahr, in the state of Uttar Pradesh, according to the Press Trust of India (PTI). The young girl and her mother approached a women's police station to report a rape, but the child was promptly put in a cell for several hours, the outlet notes.

CNN-IBN reports that at least two female officers at the station have already been suspended. An investigation is ongoing.

"The child is a minor," Senior Superintendent of Police Gulab Singh said in a press conference. "You can neither keep her behind bars nor can you hold her back as a victim in the station. This is wrong. If the lady constable has done this then we will definitely take appropriate action."

Local politician Rita Bahuguna Joshi told CNN-IBN that the incident was indicative of a bigger problem in Indian law enforcement.

"Instead of arresting the accused the police is arresting the girl," she said. "We have been saying this from one long time. No one is doing anything. I congratulate media for covering all these issues. We want strict actions to be taken against the guilty. UP government has failed to do anything. Bulandshahr: A ten-year-old rape survivor was put behind bars by the Bulandshahr police in Uttar Pradesh when she approached them for help. The child and her mother had gone to a women's police station to file the complaint of the rape.

The child and her mother, who spent several hours behind the bars, were freed only after locals created an uproar. Two women constables have been suspended while two sub-inspectors, including the station-in-charge, have been sent to police lines following the incident.

"The child is a minor. You can neither keep her behind bars nor can you hold her back as a victim in the station. This is wrong. If the lady constable has done this then we will definitely take appropriate action," SSP Gulab Singh said.

A local goon accused of raping the minor is absconding. Washington police accused of 'disturbing' failures to investigate rape

Police in Washington DC frequently fail to investigate reports of rape, and treat victims so dismissively at times, that they experience fresh trauma while the chances of the perpetrator being caught are undermined, according to a comprehensive report due out next week.

Campaign group Human Rights Watch is expected to uncover "disturbing evidence of police failure" in a 200-plus page report after a two-year investigation into law enforcement practices in the US capital.

But although shocking, the situation in Washington is far from isolated. There are widespread examples across the US of the police routinely neglecting crimes of sexual violence and refusing to believe victims.

"This is a national crisis requiring federal action. We need a paradigm shift in police culture, because rapes and sexual assaults are being swept under the rug, and too many victims are being bullied," said Carol Tracy of the Women's Law Project, a legal advocacy group that specialises in sexual violence cases....

Sara Reedy, 27, last year won a $1.5m settlement from the Cranberry police near Pittsburgh after they did not believe she had been raped at gunpoint and arrested her. She was about to stand trial when her perpetrator was caught elsewhere....

In Cleveland, Ohio, serial rapist and murderer Anthony Sowell was caught in 2011 after killing 11 women, six of them after a rape kit was disregarded. Milwaukee serial rapist Gregory Below was finally sentenced to 350 years in 2011, but three of his victims said the police dismissed their cases initially....

Sara Reedy, the rape victim accused of lying and jailed by US police, wins $1.5m payout

Pittsburgh woman raped at gunpoint and charged with fabricating her story has won a settlement after a marathon legal battle, changing federal law along the way

....Reedy was 19 when the man entered the petrol station near Pittsburgh where she was working to pay her way through college and pulled a gun. He emptied the till of its $606.73 takings, assaulted her and fled into the night. But the detective who interviewed Reedy in hospital didn't believe her, and accused her of stealing the money herself and inventing the story as a cover-up. Although another local woman was attacked not long after in similar fashion, the police didn't join the dots.

Following further inquiries, Reedy was arrested for theft and false reporting and, pregnant with her first child (by her now ex-husband), thrown in jail. She was subsequently released on bail, but lost her job. More than a year after attacking Reedy, the man struck again, but this time he was caught and confessed to the earlier crime.

When the charges against her were dropped, Reedy sued the police and has now won a marathon legal battle and a $1.5m (£1m) settlement against the detective who turned her from victim into accused. The payment was agreed earlier this year, but can be revealed only now because of a non-disclosure clause that was part of the settlement....

Upon being bailed, she was turned away from a local victim help centre, and old school friends spread rumours about her. Even her parents expressed doubts about their daughter's veracity after talking to Evanson. But a month before Reedy's trial, Wilbur Brown, 44, was arrested after raping a woman in a convenience store several miles away. He admitted attacking Reedy too, and in 2006 she was in court to see him plead guilty to assaulting 10 women. He is now serving life in prison.
