Cardinal George Pell’s role in setting up a Catholic Church compensation scheme for victims of pedophile priests will be scrutinised on Thursday at the child abuse royal commission.
Pell was archbishop of Melbourne in 1996 when the Melbourne archdiocese decided to respond to growing allegations of child sex abuse by its clergy. The church considered creating a legal entity that could be sued by victims, but designed the Melbourne Response compensation scheme instead.
Cardinal Pell told the royal commission earlier this year he believed the church should now create an entity that could be sued.
A Victorian parliamentary inquiry last year recommended the Catholic Church be incorporated so it could be sued....

Child sexual abuse royal commission: O'Callaghan advised abuse victims on strength of cases

The man in charge of the Catholic Church's so-called Melbourne Response to allegations of child abuse has rejected suggestions he failed to encourage victims to go to police.
Peter O'Callaghan QC has been dealing with complainants and deciding whether they are eligible for compensation since the scheme began in 1996.
He was repeatedly questioned about the legal integrity of his decision-making at today's hearing of the Royal Commission into Institutional Responses to Child Sexual Abuse.
Mr O'Callaghan has been a Queen's Counsel for 40 years and said the Melbourne Response was based in canon law and "natural justice".
He said when there was a dispute with a claim he would take on a role similar to a magistrate in a criminal case.
He was again asked repeatedly why he did not report cases of abuse to Victoria Police and why he took it upon himself to advise victims on the potential strength of their cases....
Yesterday he told the commission he had made more than 330 adverse findings against priests within the Melbourne archdiocese since the complaint's procedure began.
The church has paid out more than $17 million to abuse victims through the scheme.
But victims were told if they chose to go to police, they were no longer eligible for compensation....

Federal officials sought the public's help Monday to find a suspected child pornography distributor.
The U.S. Immigration and Customs Enforcement's Homeland Security Investigations said "John Doe" helped facilitate one of the largest underground networks ever encountered by law enforcement.
ICE said the man was the only remaining suspected administrator of the website. They believed the suspect's name was Shaun and that he may be between the ages of 40 and 50....
The search was part of Operation Round Table, one of the largest child exploitation investigations in history. It involved victims in 39 states, including Connecticut, and five additional countries.
As a result of the operation, investigators said they identified 251 victims. Eight of the victims were female while 243 were male. The majority of the victims were between 13 and 15 years old. A handful of victims were 6 years old and younger....

Victims of rape and sexual abuse at the Defence Force were never told about a Government taskforce set up to investigate instances of abuse in the military and provide compensation to those affected.
The ABC TV's Four Corners program has broadcast four case studies of former cadets who report being sexually assaulted and raped at the Australian Defence Force Academy in the 1990s and 2009 but have not had their cases investigated by a specialist taskforce, the Defence Abuse Response Taskforce (DART).
DART was established to assess complaints of abuse, particularly of the ADFA 24 cases - a group of about two dozen cadets who were sexually abused at the military college between 1994 and 1998. It would also determine whether any ADFA 24 victims or perpetrators are still serving members of the ADF.
However, the Four Corners investigation revealed only seven of the ADFA 24 have lodged submissions, and the deadline for submissions was in May last year....
DART has already assessed more than 2,400 complaints of abuse, paid $28 million in compensation and referred 63 matters to police....

The Liberal government announced a $29-million tentative settlement for the abuse victims of the Nova Scotia Home for Colored Children on Tuesday.
It’s a first step in a proposed two-prong process the McNeil government had promised some 130 to 150 former residents of the Dartmouth home who had endured decades of severe physical, sexual and psychological abuse while there.
Most of the victims were black, orphaned, or from homes where families could no longer look after them. Their cries for the abuse to be acknowledged had largely gone unanswered, until the former residents launched a class action lawsuit against the province and the home itself for failing to protect them.
The home has already settled with the residents for $5 million, but the province, under Darrell Dexter’s government, continued to wage the battle against the action being certified. The total settlement, from the province and the home, amounts to $34 million and is to cover residents who suffered abuse at the facility from late 1951 to 1989. Residents' lawyer Ray Wagner of Wagners law firm in Halifax Lawyer said the distribution plan will go back to 1921....

According to a report in the Irish Mail on Sunday, a mass grave has been located beside a former home for unmarried mothers and babies in County Galway. The grave is believed to contain the bodies of up to eight hundred babies, buried on the former grounds of the institution known locally as “The Home” in Tuam, north of Galway city, between 1925 and 1961
Run by the Bon Secours nuns, “The Home” housed thousands of unmarried mothers and their “illegitimate” children over those years.
According to Irish Mail on Sunday the causes of death listed for “as many as 796 children” included “malnutrition, measles, convulsions, tuberculosis, gastroenteritis and pneumonia.”
The babies were usually buried without a coffin in a plot that had once housed “a water tank,” the report claims. No memorials were erected, the site was left unmarked and unmourned.
The staggering mortality rate of “The Home” was apparently replicated elsewhere in Ireland....

ROME — Pope Francis said Monday that he plans to celebrate a Mass with a small group of victims of sexual abuse in the coming weeks and to hold a private meeting to hear from them, a session in which Cardinal Sean P. O’Malley of Boston will also take part.
Francis also revealed that three Catholic bishops are under Vatican investigation for matters related to sexual abuse, citing those inquiries as proof that there will be no “daddy’s boys” in the clergy who enjoy special privileges on his watch.
Francis did not make it clear whether those three bishops are being investigated for abuse they are alleged to have committed or for an alleged failure to respond properly to possible abuse by others....

NEWARK, N.J. — Amid calls for a Vatican investigation, Newark Archbishop John J. Myers is facing fierce criticism for his handling of a priest who attended youth retreats and heard confessions from minors in defiance of a court-ordered lifetime ban on ministry to children.
At St. Mary’s Catholic Church in Colts Neck, where the Rev. Michael Fugee had been spending time with a youth group, angry parishioners said they were never told about Fugee’s background, and they questioned Myers’ defense of the priest, the subject of a lengthy story in The Star-Ledger....
Fugee, 52, is a priest of the Archdiocese of Newark and under Myers’ supervision. His work at St. Mary’s, however, was in the neighboring Diocese of Trenton, where Bishop David O’Connell has ordered the pastor of St. Mary to bar Fugee from any church activities, a spokeswoman said in a statement....
Fugee was convicted in 2003 of criminal sexual contact for allegedly fondling a 14-year-old boy’s genitals on two occasions. Three years later, an appellate court vacated the verdict, ruling the trial judge should not have allowed jurors to hear the part of Fugee’s confession in which he described himself as homosexual or bisexual. The rest of the confession was not called into question.
Rather than retry Fugee, prosecutors allowed him to enter a rehabilitation program for first-time offenders, on the condition that he undergo counseling for sex offenders and sign an agreement barring him from any work in which children are involved. The archdiocese’s vicar general, on behalf of Myers, signed the agreement as well.
Yet The Star-Ledger found Fugee has apparently violated that pledge with impunity, attending retreats and hearing confessions and traveling with members of the St. Mary youth group to Canada....

Catholics paid $36m to 600 abuse victims in Victoria

Australia's bid to prise open the secret world of endemic child sexual abuse in churches and other powerful institutions has stepped up a notch with revelations of the scale of perversion.
The Victorian inquiry resumed this week to admissions, contrition and apologies from the Catholic Church, which said it had paid A$30 million ($36 million) in compensation to about 600 victims of deviant priests in the state.
Next week the New South Wales special commission of inquiry will open its hearings in Newcastle, north of Sydney, in the diocese that triggered both the state inquiry and the federal royal commission into abuse of children in the care of religious, government and other institutions.
A key focus of the NSW hearings will be the late, defrocked priest Denis McAlinden, whose long-term abuse of dozens of children was known to the church but hidden as he was shuffled between Australia, Papua New Guinea and New Zealand, where he worked at Tokomaru Bay near Gisborne.
McAlinden - whose predecessor was later convicted of child sexual abuse - was central to investigations by Detective Chief Inspector Peter Fox, the whistleblower policeman who sabotaged his career by making public alleged cover-ups by the Church....
In Ballarat, Church officials knew by 1975 that priest Gerald Ridsdale was a paedophile, but allowed him to continue working. Ridsdale was later twice convicted for child sexual abuse, and moved to different parishes.
The Catholic Order of Salesians of Don Bosco, which works with homeless and at-risk youths, and runs schools and boys' clubs, said it had paid more than A$2 million in compensation to abuse victims and had 49 complaints against its priests in Victoria, three of whom will face courts this year. The Brothers of St John of God said it had received 31 cases of abuse by 15 members.

The prostitution industry is an enormously powerful and pervasive culture presence."....
According to Forbes magazine, the contemporary legal pornography business is a $56-billion global industry, including a huge presence of some big multinational companies....
In a research paper titled "The Use of New Communication Technologies for Sexual Exploitation of Women and Children", Donna Hughes.... This study quotes experiences of police officers who blame the Internet particularly for the spread of child porn. Raymond Smith of the US Postal Inspection Service, who has handled hundreds of cases of child pornography, found that the rise in Internet use by sexual predators has also increased their use of the US mail service. He said that from the time they first started investigating child pornography in the early 1980s until five years ago, they had almost eliminated the distribution of child pornography.
But since the Internet this has steadily increased. In 1998, 32 per cent of cases of distribution of child porn were related to the Internet. In 1999, 47 per cent were Internet-related, and in 2000 this had risen to 77 per cent. This paper concludes, "The use of new communication and information technologies for the sexual exploitation of women and children is creating a crisis for women's and children's status, and dignity all over the world."

While many of the names of the abusers and accusations against them were known, the files reveal previously undisclosed details of how the church transferred priests out of state, sent them to therapists who wouldn't report crimes and suppressed information from reaching the public. Lawyers for the archdiocese and priests who objected to the records being released did not return phone calls or an email seeking comment. Among the revelations in the trove of documents:
The church records show the archdiocese maneuvered behind the scenes to avoid a possible lawsuit against a priest over abuse allegations in Los Angeles. In 2007, five former altar boys from Tucson, Ariz., were awarded $1.5 million each as part of the archdiocese's $660 million clergy-abuse settlement. The five said they were abused by the Rev. Kevin Barmasse, who was sent to Arizona during the 1980s after he'd been accused of child molestation in Los Angeles. The records show Monsignor Thomas Curry told Mahony in a Nov. 10, 1989, confidential memo that "the young boy involved is now about eighteen, so Kevin should certainly not return for another two years by which time the period for filing law suits will have passed." Later that month, Mahony advised Barmasse to stay away from Los Angeles. "Your presence in this area ... would greatly increase the possibility of a suit against you," Mahony wrote. Barmasse was never criminally prosecuted.

Josh Powell's in-laws want law to protect kids
February 2, 2013 OLYMPIA — The parents of a missing Utah mother pushed Friday for changes in Washington state laws on custody cases, saying proposed legislation might have prevented the killing of their two grandchildren.
Chuck and Judy Cox testified before a state Senate committee considering a bill that would restrict or block visitation rights for someone who is the subject of a murder investigation.
They told lawmakers the legislation could have changed the course of the case involving their missing daughter, Susan Powell, whose husband, Josh Powell, killed himself and their young kids during a parental visit last year....

Two alleged victims of a sophisticated paedophile ring at the centre of a police investigation claim they were taken on trips to Amsterdam where they were sexually abused in brothels in the 1980s.
One male victim had been taken from the Grafton Close care home in Richmond, south-west London, it is claimed, and, as well as being trafficked in Amsterdam, was rented out to customers at the Elm Guest House, a bed and breakfast nearby. Another man has claimed he was taken to Amsterdam on a different trip.
Police are understood to be looking into the men's claims as part of Operation Fernbridge, an investigation into historic child abuse set up in the wake of the Jimmy Savile scandal. Detectives are building a picture of the reach of the network – which allegedly used the property – and have seized a number of files from local authorities.
The Elm Guest House in Rocks Lane, Barnes, said to have been frequented in the Seventies and Eighties by prominent peoples including former Tory politicians, is at the centre of the investigation....

Josh Powell's in-laws want law to protect kids
February 2, 2013 OLYMPIA — The parents of a missing Utah mother pushed Friday for changes in Washington state laws on custody cases, saying proposed legislation might have prevented the killing of their two grandchildren.
Chuck and Judy Cox testified before a state Senate committee considering a bill that would restrict or block visitation rights for someone who is the subject of a murder investigation.
They told lawmakers the legislation could have changed the course of the case involving their missing daughter, Susan Powell, whose husband, Josh Powell, killed himself and their young kids during a parental visit last year....

Two alleged victims of a sophisticated paedophile ring at the centre of a police investigation claim they were taken on trips to Amsterdam where they were sexually abused in brothels in the 1980s.
One male victim had been taken from the Grafton Close care home in Richmond, south-west London, it is claimed, and, as well as being trafficked in Amsterdam, was rented out to customers at the Elm Guest House, a bed and breakfast nearby. Another man has claimed he was taken to Amsterdam on a different trip.
Police are understood to be looking into the men's claims as part of Operation Fernbridge, an investigation into historic child abuse set up in the wake of the Jimmy Savile scandal. Detectives are building a picture of the reach of the network – which allegedly used the property – and have seized a number of files from local authorities.
The Elm Guest House in Rocks Lane, Barnes, said to have been frequented in the Seventies and Eighties by prominent peoples including former Tory politicians, is at the centre of the investigation....

The Vatican has rejected claims by Irish PM Enda Kenny that it sabotaged efforts by Irish bishops to report child-molesting priests to police.
It follows the damning Cloyne Report that showed how allegations of clerical sex-abuse in Cork had been covered up.
In a speech to parliament in July, Mr Kenny accused the Church of putting its reputation ahead of abuse victims.
The Vatican said it was "sorry and ashamed" over the scandal but said his claims were "unfounded"....
"The Holy See... in no way hampered or sought to interfere in any inquiry into cases of child sex abuse in the Diocese of Cloyne."
"Furthermore, at no stage did the Holy See seek to interfere with Irish civil law or impede the civil authority in the exercise of its duties."
'Misinterpretation'
Mr Kenny had told the Irish parliament that the report into how allegations of sex abuse by priests in Cork had been covered up showed change was urgently needed.

"The rape and torture of children were downplayed or 'managed' to uphold instead the primacy of the institution, its power, standing and 'reputation'," he said.
Parliament then passed a motion deploring the Holy See for "undermining child protection frameworks" after a letter to Irish bishops appeared to diminish Irish guidelines on reporting sex abuse by referring to them as "study guidelines".....
Released in July, the 400-page Cloyne Report found that Bishop John Magee - who stood down in March 2009 after serving as bishop of Cloyne since 1987 - had falsely told the government and the health service that his diocese was reporting all abuse allegations to authorities.
It also found that the bishop deliberately misled another inquiry and his own advisors by creating two different accounts of a meeting with a priest suspected of abusing a child - one for the Vatican and the other for diocesan files.
It discovered that, contrary to repeated assertions on its part, the Diocese of Cloyne did not implement the procedures set out in the Church protocols for dealing with allegations of child sex-abuse. It said the greatest failure was that no complaints, except one in 1996, were reported to the health authorities until 2008....

Church leaders and government watchdogs covered up 'endemic' and 'ritualised' abuse of thousands of children in Roman Catholic schools and orphanages in the Irish Republic, a shocking report revealed yesterday.
For six decades, priests and nuns terrorised boys and girls in the workhouse-style schools with sexual, physical and mental abuse.
But officials in Ireland's Catholic Church shielded paedophile staff from arrest to protect their own reputations despite knowing they were serial attackers, according to the 2,600-page report, which took nine years to complete.
Irish government inspectors also failed to stop the chronic beatings, rape and humiliation, it found.
About 35,000 children and teenagers who were orphans, petty thieves, truants, unmarried mothers or from dysfunctional families were sent to Ireland's network of 250 Church-run industrial schools, reformatories, orphanages and hostels from the 1930s up until the early 1990s.
The report by Ireland's Commission to Inquire Into Child Abuse found 'a climate of fear, created by pervasive, excessive and arbitrary punishment, permeated most of the institutions and all those run for boys'.
It added: 'Children lived with the daily terror of not knowing where the next beating was coming from.'
Judge Sean Ryan, who chaired the commission, said that when confronted with evidence of sex abuse, religious authorities responded by moving the sex offenders to another location, where in many instances they were free to abuse again.
'There was evidence that such men took up teaching positions sometimes within days of receiving dispensations because of serious allegations or admissions of sexual abuse,' the report said. 'The safety of children in general was not a consideration.'

They told a press conference in central London today that repeated apologies meant nothing and they wanted "truth, justice and accountability."

Jesuit spokesman Thomas Busch said Thursday the order has not yet made a final decision on the amount that will be offered to about 200 victims who were abused decades ago.

The book relies in part on newly unearthed tapes from the National Archives that document how Nixon’s aides plotted to destroy Anderson by planting forged evidence with him and spreading false rumors about his sex life and that of one of his associates.
Feldstein also has uncovered new evidence that documents one of the more outrageous schemes of the Nixon presidency: a plot to assassinate Anderson by either putting poison in his medicine cabinet or exposing him to a “massive dose” of LSD by smearing it on the steering wheel of his car. While the aborted scheme to murder Anderson has been reported — and disputed — before, Feldstein found new corroboration: A confession before his death by ex-White House “plumber” Howard Hunt.
